calabria-tour.it (“Tour Calabria,” “we,” “our,” “ours”) is an online platform through which you can purchase tourist and leisure offers directly online or through customer service, at competitive prices, from qualified and valid operators (hereinafter referred to as Partners) active in the Calabria region.
On calabria-tour.it, you can also purchase tourist packages and stay offers at selected accommodation facilities.
These general terms and conditions (hereinafter General Conditions) govern the use of our website calabria-tour.it (hereinafter Site) by users, define our respective rights and obligations, and regulate the relationship between Site users who purchase an offer (hereinafter Customers) and the respective Partners of calabria-tour.it. It is recommended to carefully review the content of the General Conditions, as they apply to all our services available online, via email, or by phone. calabria-tour.it therefore asks you, at the start of each purchase procedure, to declare that you have read, understood, and accepted the terms and conditions set out below.
1. Service Description
The Site is an IT platform that allows our Partners to advertise and sell their offers. You can purchase the offers of our Partners by contacting our customer service or directly online – where possible – using the Site’s e-commerce platform (we will refer to this as Online Purchase). In any case, by making the purchase, you enter into a sales contract (legally binding) directly with the Partner proposing the offer. calabria-tour.it is limited to managing the web pages of the Site, providing support to users in the pre-sale and sale phases, and managing the e-commerce platform. You can find out the name of the proposing Partner and seller of the offer simply by registering on the site. When you purchase an offer, we transmit the details of your purchase to the respective Partner and send you a confirmation email of the completed purchase.
2. Age Requirement
You declare that you are of legal age (i.e., you have reached the age of 18) and have the necessary legal capacity to purchase offers, thereby fully accepting the content of the General Conditions.
3. Use of the Offer and Sales Conditions of Partners
calabria-tour.it provides, on the web pages hosting its Partners’ offers, the specific sales conditions of the proposing and selling Partner. These sales conditions may relate, for example, to the location of the offer’s provision, opening hours, available spots, offered services, withdrawal conditions, and, in general, anything necessary for an informed purchase on your part. It is your specific obligation, before completing the purchase, to review and accept the specific conditions of the Partner selling the chosen offer. By accepting these General Conditions, you declare that you have reviewed and accepted the specific conditions that apply to the purchased offer. The services included in the offers are carried out, respecting the information provided by you during the purchase and the sales conditions of the relevant Partner, for the benefit of the individuals you, or the representative (if you are not present or, for example, if you want to give a gift) designated by you (in the case of Online Purchase, you can directly enter the name of a representative on the Site, or communicate it to customer service). It is always within the discretion of the Partners to request, in addition to the numerical code identifying your purchase (only in the case of Online Purchase), your name or that of the representative and to verify their respective identities with a valid document. Similarly, Partners may request beneficiaries to present a valid identification document to verify, if necessary, their age. When specific conditions set by the Partner are envisaged for the offer to be provided, as indicated on the pages of the Site hosting the offer, the Partner may request a preliminary acknowledgment before proceeding with the offer’s provision. When the offer involves the performance of a particularly risky activity, for which the subscription of a specific disclaimer is envisaged, the Partner may require beneficiaries to fulfill this preliminary requirement.
4. Purchase and Payment Procedure
On the Site, you can view the total price of various proposed offers, as well as any down payment on the same price required to complete the online sale of the offer. The amount (down payment or total price) paid by you through the assistance of customer service or – where possible – directly online using our e-commerce platform, is credited to calabria-tour.it, which collects it on behalf of the Partner selling the offer. The invoice documenting the electronic payment, when requested, is therefore issued by the same Partner. Customer service accepts payments through the PayPal circuit (electronic payment). The eventual balance of the price of the offer you purchased, unless otherwise indicated in the specific sales conditions of the Partner, is paid directly to the latter when you visit them to enjoy the services included in the offer. The payment of the balance is due from you even if you do not show up or decide not to avail yourself of the offer, unless you have exercised the right of withdrawal as provided in the subsequent point 6.
5. Conclusion of Sales
Online Purchase
To purchase Partner offers, you must complete the purchase process implemented on the Site and make the payment, through the PayPal circuit, of the corresponding price or a down payment on the price.
As soon as the Site receives confirmation from PayPal of the successful payment, it initiates additional real-time computer procedures that ensure:
sending a confirmation email to your email address, containing a summary of the general and specific conditions applicable to the contract, information about the essential characteristics of the offer, an indication of the price and/or down payment paid online, and an indication of any remaining balance on the price to be paid;
sending an email notification to the Partner for further confirmation of the online sale of the offer you purchased, including its essential details. Sales concluded in this way have their effects exclusively between you and the Partner.
calabria-tour.it, limiting itself to the management of the Site and its related e-commerce platform, remains uninvolved in the online sale of the offer.
Purchase through Customer Service
You can purchase our Partner’s offers through the PayPal circuit. You will be directed to a dedicated web page for online payment of the corresponding price or a down payment on the price.
Upon receiving confirmation of the successful payment, we will send a confirmation and summary email to your email address. It will be our responsibility to notify the relevant Partner of the completed sale. Sales concluded in this way have their effects exclusively between you and the Partner.
calabria-tour.it, limiting itself to the management of the Site and customer assistance, remains uninvolved in the sale (online and offline) of the offer.
6. Right of Withdrawal and Changes
The withdrawal conditions of each Partner are indicated on the web pages hosting their offers. In case of renouncing the use of the purchased offer, you are invited to promptly communicate it: in this way, you will prevent our Partner from incurring unnecessary financial damage, and you from having to settle the price of the purchased offer, despite not availing yourself of it. In the event of a “no-show” or cancellation beyond the last deadline for exercising the right of withdrawal, your obligation to fully pay any remaining balance remains. You can communicate your withdrawal by using the online services offered by the Site (only for Online Purchase) or by directly contacting the relevant Partner. Depending on the specific withdrawal conditions of each Partner, your cancellation may be subject to penalties up to the total payment of the remaining balance. The application of such penalties is entirely the responsibility of the Partners. The down payment on the total price of the offer, paid during the purchase process, is not refunded under any circumstances and must therefore be considered as NON-REFUNDABLE. Any changes to the choices and/or indications expressed by you at the time of purchasing the offer must be requested from the relevant Partner, who alone can accept or reject them based on their sales conditions and their autonomous and independent evaluations.
7. Order Proof and Archiving
Data related to completed sales on the Site is regularly stored in the calabria-tour.it database and has the same evidential value as all written documents.
8. Price Indication
The prices stated on the Site are intended for the entire use of the offer as described on the Site and include VAT. The crossed-out price indicates that a promotion is ongoing. calabria-tour.it, also due to specific agreements with its Partners, always seeks to offer the lowest rate among those on the market. Therefore, we invite you to inform us if this is not the case.
9. Liability
calabria-tour.it is never a contractual party in the sales of Partner offers and, consequently, is not liable for any contractual or non-contractual damages suffered by third parties in the execution of services provided by Partners. It also does not bear responsibility for the accurate fulfillment of services included in the offers, which should solely be referred to the relevant Partners.
calabria-tour.it and its Partners are committed to diligently and professionally fulfilling their respective duties, for which they alone can be held responsible. Therefore, calabria-tour.it’s liability is limited to the proper management of the sales procedure in accordance with the instructions provided by Partners regarding prices, rates, and seat availability. Such instructions remain the full and sole responsibility of our Partners.
calabria-tour.it has no control or liability regarding the quality, safety, legality of marketed offers and is not responsible for the truthfulness and accuracy of information provided by Partners, nor can it be held responsible for any errors (including obvious and typographical errors), inaccurate, misleading, or false information.
It is the Partner’s obligation to ensure adequate information to their customers and to convey any additional information or any form of further communication relevant to the use of the offer to their customers.
calabria-tour.it is not responsible for malfunctions and/or technical interventions attributable to third parties that may partially or completely affect the functionality of the Site. It does not guarantee continuous and uninterrupted access to the Site and its services, which may be conditioned by factors beyond its control.
calabria-tour.it also reserves the right at any time to temporarily disconnect its services or any part thereof, for example (but not only) to carry out technical maintenance and/or update the IT and web platform or for other improvement interventions. You, as a user of the Site, acknowledge that calabria-tour.it cannot be held responsible, either to you or to third parties, for the suspension or interruption of its services and/or the Site.
calabria-tour.it is in no way and under no circumstances responsible for the processing of your personal data carried out by Partners, who act with full autonomy and independence from us.
The liability of calabria-tour.it and its Partners is excluded in all cases where the non-performance or inaccurate fulfillment of services can be attributed to the offer beneficiary. In this regard, merely by way of example, the following cases are mentioned:
Non-presentation or delay beyond the limits tolerated by the Partner and communicated on the Site;
Non-compliance with the sales conditions of the Partner;
Refusal to sign the liability waiver by beneficiaries of services that involve particularly risky activities;
Refusal or inability to prove identity with a valid identification document by beneficiaries.
10. Copyright and Intellectual Property Rights
The Site may be used exclusively for consulting and purchasing offers. Unauthorized use of the Site and the material contained therein constitutes a violation of the intellectual property rights of calabria-tour.it or third parties who have licensed it. calabria-tour.it is the exclusive owner of the calabria-tour.it® trademark and the calabria-tour.it domain. The user agrees to preserve all indications of trademarks and copyright on downloaded or copied materials. The use of these materials on any other website is prohibited, unless explicitly authorized in writing by calabria-tour.it. 12. Changes to the General Conditions

These General Conditions and the relationships between you and calabria-tour.it are governed by Italian law. calabria-tour.it and its Partners consider achieving full satisfaction of their visitors and Clients a priority in their management and declare their common willingness to promptly address any shortcomings for which they may be actually responsible. In this same perspective, if it should occur, you are required to attempt mandatory conciliation, to be carried out electronically, in compliance with the specific procedures provided for in Article 5, paragraph 5 of Legislative Decree 28/2010. The original text in the Italian language of these General Conditions has been translated into other languages. The translated version is unofficial and aimed at assisting foreign users of the Site, therefore, it does not have legal value. In case of disputes or inconsistencies or discrepancies between the Italian text and the translated one, the Italian text prevails and constitutes the only legally reference.
